<div class="views-field views-field-body"> <div class="field-content"><p>政府資料是否對民眾開放、透明、並公開接受監督，是衡量國家民主程度的重要指標。除此之外，隨著近年來公民意識逐漸升高，社會大眾對政府施政與公共議題也愈發關心。為了掌握政策制定流程與監督政府施政，公民更需即時取得支撐政策形成的相關資料。在科學發展路途，研究資料的累積與分享，更是深受學術社群重視。以開放協作方式，共同設計實驗，收集儲存處理巨量原始資料，逐漸成為常態。在這同時，開放資料議題也牽涉到個人資料處理以及隱私維護，資料儲存與散布的技術標準，以及共用資訊服務平台等多項層面。如何營造、改善並向社會推廣開放資料的環境，是眾人值得關心的議題。</p>
<p>中華民國開放系統協會 (COSA) 舉辦的「開放資料座談會」，將於106年8月18日週五下午三點到五點，在台北市重慶南路二段6巷10號（孫運璿科技･人文紀念館）舉行。座談會邀請到唐鳳（行政院政務委員）、彭盛韶（時代力量智庫）、林誠謙（中研院物理所）、王大為（中研院資訊所）四位先生與談，透過案例分享與討論，希望能引起社會大眾對此議題的重視與參與。詳細資訊與報名方式請見開放系統協會網頁 。</p>

<div class="views-field views-field-body"> <div class="field-content"><p>呈現寡占狀態的學術出版市場，衍生出文獻集中化的現象，加上不合理的商業模式，使各大圖書館漸漸無力負擔出版商不斷提高的期刊訂閱費用。這樣的狀況與爭議於近年浮上檯面，愈演愈烈，在荷蘭、德國，以及臺灣，不約而同皆發生了各校圖書館集中談判，進而發動抵制的抗議行動。雖然此場戰役並未結束，甚至可以說是方興未艾，本文，就各地對學術期刊拒訂進而抵制的重要發展進行紀錄，以協助讀者能迅速簡要的了解其變化脈絡。</p>

<div class="views-field views-field-body"> <div class="field-content"><p>創用CC 授權條款的應用和推廣，為著作權利的靈活運用提供了許多新機會，然而，要救濟財團與公眾之間權利地位失衡的狀況，單靠創用CC 授權條款，並不足以成為全面性的解決方案。所以近年 Creative Commons 各合作組織，也很積極參與各地區著作權法的修正與討論。</p>
<p>11 月的第三週在歐洲日內瓦，Creative Commons 參加了世界智慧財產權組織 (WIPO) 著作權與相關權利委員會一年兩度的會議，Creative Commons 從 2011 年以來一直在 WIPO 擁有「觀察員」身份，這表示不但可以參加會議，還可以對委員會的活動提供書面或口頭的意見回饋。</p>
<p>CC Australia 的 Delia Browne 代表參與此次會議，明確的指出：Creative Commons 支持對教育性限制和例外，設立最低標準的強制性，以此來保障一般民眾最基礎對教育讀物的近用地位。</p>

<p>Measurement Lab 這個具有學術研究並商業發展雙重面向的單位，目前率先將其調查分析所得的相關資料，自行採 CC0 - 公眾領域貢獻宣告的方式，Open Data 出來給不特定多數人皆可不受限制利用，其動機、作法，以及產生影響，非常具有報導與持續觀察的價值！</p>

<div class="views-field views-field-body"> <div class="field-content"><p>Rights Statements 和既存的公眾散布機制，是處於相輔相乘、互相填補的定位，進一步來說，Rights Statements 並沒有創設任何新的授權條款或權利宣告模組，它僅是在既成的架構下，疏導特色相近的授權模式能被統合分類，以讓使用者在瀏覽相關數位素材時，能收一目了然、快速領略其基礎使用狀態之效。</p>
<p>基本上，Rights Statements 這三大分類、十二細項的文化館藏權利標示的模式，在我國亦多能被直接適用，在統合各個文化館藏自訂提供模式讓公眾了解的面向，更具有他山之石，可以攻錯的參考價值。且就現行普遍流通的創用CC 授權條款及其他公眾授權條款，得收相互輔助之效。其於權利盤點上揭示的分階機制，亦相當程度有助於文化館藏機構，據以學習先採輕簡盤點後進行素材公開披露，後續再集中資源釐清重要專案的權利狀態，以妥善文化素材開放授權的後續舉措，並收積極施政令民眾有感之效。</p>

<div class="views-field views-field-body"> <div class="field-content"><p>文化館藏基礎權利標示 (RightsStatements.org) 是一個由歐洲數位典藏平台 - Europeana Collections 與美國數位公眾圖書館 (Digital Public Library of America ,DPLA) 共同發起的協力專案，此一文化館藏權利標示套件的主要建置目的，在於協助跨界跨域的美術館、圖書館、檔案館，以及博物館，能以最淺顯方便的標示模式，來述明自身數位館藏最基礎的權利狀態，從而便利、加速該數位素材的流通與被使用。</p>
<p>許多具歷史性的典藏文物，其依著作權法的基本預設，權利狀態應已進入眾人皆可不受限制利用的公眾領域 (Public Domain)，然而也正因為年代久遠，若缺乏直接證據或得以準據的捐獻文件，要確認此一狀態亦是充滿了不確定性，且全面盤點過程高度耗費人力、時間等相關資源；然而，公開展示的素材並不代表其權利人已採開放式授權，從而公開與開放之間，具有相當可操作的彈性空間，館藏機構若在政策上同意將數位藏品先行公開上網，當有助於文化素材提升曝光度，此時在僅供公開瀏覽的權利盤點上之舉措，可輔以要項式的初階處理，在清簡人力、時間等資源的前提下，以 Rights Statements 標準化的模組，就素材的基礎權利狀態簡要述明，而若上級機關構或社會大眾對於特定館藏，提出開放式提供深度利用之具體訴求，後續再撥付必要的資源進行細節的權利盤點。</p>

<p>此篇我們從開放近用 (Open Access) 發展史的角度來觀察，arXiv、Scholarly skywriting、SciELO、PLoS，其初始脈絡、遭遇阻力，以及商業模式都將有所著墨，以供關心此一領域發展的朋友，據以推衍未來的發展動向！</p>

<div class="views-field views-field-body"> <div class="field-content"><p>除了重製與散布，CC授權提供的其實是一個更為深度的授權範圍，例如常被一般人忽略的「公開演播 (Publicly Perform)」，其實也在 CC授權素材提供的利用範圍之列。也就是說，在電視或廣播頻道裡，影片或音樂檔案播放前，常被平台機構要求出示的「公播權認證書」、「公播權授權書」等，其實早就內含於創用CC 授權的法律條款裡，只是在播放環結裡，使用者與播放者，還不知道怎麼順暢的應用創用CC 授權素材。</p>
<p>此篇以 jamendo 網站上提供的 CC授權音樂為例，簡要說明如何直接使用創用CC 授權法律條款，作為公播權說明文書的處理方式。</p>

<div class="views-field views-field-body"> <div class="field-content"><p>公眾領域裡的著作，任何人都可以自由使用。而部份的著作權利人，會在保護期間屆滿前，宣布其拋棄著作的利益，而讓作品提早進入眾人皆可自由利用的公眾領域，而若原作者已經做這樣的聲明，後續有非原作者的其他人，聲稱這些作品都是其私人的著作，轉而向該公眾領域作品的利用人索取授權金額，原作者還能對這樣的錯置行為展開司法救濟嗎？</p>
<p>Getty Images 這家圖庫授權公司，發信指責 Carol M. Highsmith 女士，在其自行架設的網站上，分享 Getty Images 擁有著作權利的照片，然而，這些照片皆 Carol M. Highsmith 自行提供給美國國會圖書館，並自由提供給所有人使用的。Carol M. Highsmith 訴請援引美國著作權法第 1202 條及 1203 條，對原作者著作權利資訊正確性進行延伸保護，以主張對 Getty Images 及其合作廠商課予 320 億台幣的民事賠償責任。此篇文章，將就公眾領域素材在未再次創作下，應用何種態度與方式進行權利管理資訊標示，進行分析與建議。</p>
