Conflicting rules: RNG/RNC Schema and Schematron in the content binding element

Right now the newest *.RNC has in the content of binding element:

element binding 
{
    (summary, condition?, decoNote*), ...

But Schematron rule prohibits summary and states that we should have here p.
Should we change the schema or the Schematron rule?
TEI has here p.
Revert our model to be compatible with TEI?

What about choosing between summary and p?
